1. Acceptance of Terms
By accessing or using theMLS.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization. If you do not agree to these Terms, do not use the Service.
2. Description of Service
theMLS.ai is an AI-powered real estate platform that provides tools for real estate professionals and home seekers, including property search, market analysis, lead management, and communication assistance. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate and complete information, keep your login credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account. You must be at least 18 years old to create an account.
4. Subscription Plans & Payment
We offer free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You can cancel at any time, and your access will continue until the end of your current billing period. Prices are subject to change with 30 days notice. Refunds are handled on a case-by-case basis; contact support@themls.ai for refund requests.
5. Free Trials
We may offer free trial periods for paid plans. During the trial, you will have access to the features of the selected plan. If you do not cancel before the trial ends, your payment method will be charged for the first billing period. Trial availability and duration may vary.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of fair housing laws; (b) scrape, crawl, or harvest data from the Service except through our approved API; (c) attempt to gain unauthorized access to our systems; (d) upload malicious code; (e) impersonate another person or entity; (f) use the Service to send spam or unsolicited communications; (g) reverse engineer the Service or our AI models; (h) resell access to the Service without our written consent.
7. AI-Generated Content
Our Service uses artificial intelligence to generate market analyses, property recommendations, communication drafts, and other content. While we strive for accuracy, AI-generated content is provided for informational purposes only and should not be considered as professional real estate, legal, or financial advice. You are responsible for verifying the accuracy of AI-generated content before relying on it or sharing it with clients.
8. Your Content & Data
You retain ownership of all content you upload to the Service, including client data, listing information, and communications. By using the Service, you grant us a limited license to process this content as necessary to provide the Service and improve our AI features. We do not claim ownership of your content. You are responsible for ensuring you have the right to upload and process any data you input into the Service.
9. Intellectual Property
The Service, including its software, design, AI models, documentation, and branding, is owned by theMLS.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, theMLS.ai and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether arising from your use of the Service, AI-generated content, or otherwise. Our total liability shall not exceed the amounts you have paid to us in the twelve months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.
13. Termination
We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice. Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (such as intellectual property, limitation of liability, and dispute resolution) will survive.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
